No, the brake lights are NOT on if you are using auto-hold. I wondered about this from the start on my '15 X5. It's easy enough to check, just check your rear view mirror while you in a drive through. You'll see the reflection of the brake lights on the car behind. Come to a stop using the brakes, brakes lights are on. Pull up on the auto-hold, release your foot of the brake and the brake lights go out. That is how it has worked on mine from the beginning. If anyone was paying attention, then it would just look like you were driving a manual transmission.
Maybe they behave differently in different markets due to technical rules and regulations in different countries regarding how brake lights work. In any case, it's an easy enough thing to find out. At night, just look in you mirror at anything that is close enough to be lit by your brake lights.
