No Export Agreement
I was in my dealer the other night changing some options on the car and my salesperson showed me a curious email from BMWNA with a form attached to it. Apparently there have been problems with people buying F15s and exporting them China and other countries where apparently people are paying twice the price. BMW is now requiring that you sign an agreement saying that you will not export the vehicle before you are allowed to pick it up. Anyone signed this form?

Judge stops US crackdown on car exports. Fed govt ordered to return $1m to LA car exporter of RR pcars bmw. Export er claims taking adv of arbitrarge. Judge says nothing inheriently wrong with wire transfers, no probable cause of funds seized were proceeds of wire/mail fraud.Homeland security says some of funds were from money laundering. Exports to foreign countries can command 3x price US dealers. Actually with the strong US $, Can prices are looking good. Sorry no link as I am sourcing this from hard copy International NY times. In Milan for 7 days, seen no F15 few E70, lots of bmw bikes.

Yes. My dealer's finance manager asked me to sign one of those too. I didn't argue the topic since most of those types of agreements are not worth the paper they are written on and I'm keeping the car anyway. Unless my reserve price is met on eBay ; )

I signed the agreement as well. A few dealers actually backed out of the deal since they were not comfortable with the cash deal. One CA told me some dealer in California got fined $600k from BMW.

...this topic is indeed highly interesting to me.
Hypothetically, if I were about to move to Canada (Aug), and bought my car here in the states before that move I would be fined 20K? There is no intention of selling the car on arrival to canada. Does this agreement only apply for those intent on selling the cars after export vs just exporting the cars (with/without change in ownership)? |

$65K in the US versus $115K in Switzerland cannot be explained be taxes (VAT, excise) only. If it were only due to taxes BMW would not care about any no export clauses. If so, and if difference in price is so huge, that means BMW may be selling some models in the US below costs which is illegal in most countries or is cross-subsidising its sales in the US with profits from sales elsewhere, which is against the multilateral trade rules (although these apply on the governmental level) and fair competition.

The export document I signed specifically mentioned I cannot export it for 2 years.. I guess it should be fine after 2 years..

Very interesting.... yeah, it might be mine, but also, BMW can refuse to sell me a vehicle if they don't think I'm a good customer... though decisions.. I heard about the export list and the people on that list can never but a MB or BMW.... EVER! I can imagine that atrocity!

This has become increasingly common, especially with the diesel versions. I know Mercedes dealers who will run an "export check" on all purchasers of diesel ML and GL models. Usually there is a term of one or two years, and yes, the documents are binding, and extremely enforceable.
