Same thing happened to me (in Seattle no less! ) when an older couple just happened to be walking to their car as I was surveying the cracked fog light and scrapes to my Benz. I look up and lo'n'behold, they open the car that's directly in front of mine... complete with black paint on the rear of their lighter colored car. Talk about good timing. After asking them about it, the husband admitted he may have felt something while backing out the night before.
Turns out he was a lawyer from Reno, so sent me a check after I got multiple quotes for his "team" to approve. That and the requisite indemnity clause/letter.
Totally agree they were being shady. He didn't put up a fight and pretty quickly offered his insurance info so I think he knew he'd been caught.

His insurance called me and said he disputes that he hit my car.

When I went out to my car this morning I noticed what at first I thought to be paint on the area...but it was in fact liquid polish that he looks to have used to try to polish the area on my car...how shady is that....

Any idea what I should do next? I'm trying to get footage from the surveilance camera in the parking lot but it's not placed in a location that would directly show him hitting my car. But it would show no markings on his front bumper when he pulled in to the spot and marking showing when he pulled out.

What a douche neighbor.

I’d file a police report for hitting the car, then vandalizing it.

Totally agree. Hopefully I can get the footage of him trying to polish the damage on my car.

I did get a quote from a body shop of $300 out the door to spot paint and blend. So that isn't too bad.

Look, it is known, all neighbors are not created equal. Ones my neighbor's kid managed himself to get to my driveway, and rode his scooter along with my wife's parked E90, falls and scratched rear right quarter panel. Neighbor came knocking on my door, apologizing and offering to pay for all repairs. We were able to laugh it off, and since that time we are a good friends. Yours, not so much.
Three hundred bucks to spot paint is.... a bit too much IMHO.

I wish I had that kind of neighbor!

Thanks for the sanity check on the repair cost. I'm going to call a few other shops for quotes.

Got a quote from a shop that will remove the flare, paint and reinstall for $300ish. Seem like a better option?

If you factor in labor cost, and spray painting, yes, it is about right.

Sounds good. Now that I have the second quote I can probably get the first shop that quoted me for spot painting to do the full R&I/repaint for the same price.

If I get it repaired prior to a decision on the insurance, am I SOL on having his insurance cover it?

That's one nasty scratch. It's unfortunate that your neighbor is giving you a hard time. But that's people sometimes... Really hope everything goes well. Keep us updated.

Karma will come for him...

I have an appointment to get Opti Coat Pro put on the car next week so I'm hoping to get this fixed by then...we'll see if that works out.

No, you're not. Insurance companies cannot force you to go to their cut-rate shops. As long as you have multiple quotes for the same ~$300, they should pay out.
Tell the insurance claims person that your neighbor touched your car in trying to polish out the scratch. Tell them you are pursuing video footage. Their tune should change after that as the $300 bill is not worth the hassle of police reports, etc. to them.

Cool, thanks Doanster.

I got a hold of our property management and they are working on getting me the video. It should show him messing around at the back of my car sometime between last night and this morning.

I plan to contact him and let him know he's been caught on candid camera messing with my car and I plan to file a police report. I think he'll probably own up at that point and remove the dispute on the claim.

Got a quote for $250 with respray of the whole flare. Took it to the original shop and he is willing to match.

I also called the neighbor and left a VM letting him know I am getting the video footage and don't appreciate him touching my car and attempting to cover up the damage. I stated I would get in touch with the police if the video shows him messing with my car. Hopefully he understands the words "video" and "police"...

Holy crap I cannot believe he tried to cover up the damage on your car. People have been shot over crap like this, maybe not so much in the PNW but definitely in Texas!

Touching a neighbor's vehicle in such a manner is like motor vehicle molestation in my book. Punishment: Life sentence - vehicular castration (forced public transportation/mass transit for life). If you can't respect the property of someone else, you can't own said property. What a tool.

I'm with you 100%. It's like admission of guilt too, why touch my car if you are so sure you didn't do the damage. I'm sure it wasn't out of the goodness of his heart. Complete garbage of a human.

Regardless of whether he then admits liability, I’d still get the police to press charges. This guy is an asshole of the highest order.

Wow, I mean scratch is bad, but for me the saddest part is that neighbor turns out to be an asshole and a creepy one too.
I'm concerned about that spiraling down neighbor relationships and ''neighbor war'' that will be now going on. I mean damage to the car can be fixed and finances can be managed somehow (insurance or not), but this situation is frustrating, at least for me. Maybe I'm too sensitive, but imho that's why I sometimes forgive people for small things like that scratch - not because people change, but because to avoid escalating issues: I can't imagine how I can I be relaxed and living with my wife and kids next to a neighbor that does such things like trespassing and messing with your property during cover of the night

And the saga continues!

The property management company responded advising one of the “directors” of the HOA reviewed the footage and didn’t notice anything strange. Subsequently the hard drive was swapped out and the footage is no longer available. WTF!!!

I did not ask anyone to review the footage. I asked for a copy of the footwge. I swear the property management company and HOA director is completely inept.

I responded to her asking how on earth in 2018 there is not a way to save the footage. I even offered previously to provide a jump drive or external hard drive to transfer the footage to...I also asked her if something more serious had happened would they have been able to save the footage and to put herself in my shoe and made it clear they deleted evidence. She of course avoids my questions and says she’ll reach out to the company that swapped the hard drives to get the footage.

This series of events is pretty unbelievable.

Based on my experience, this is how they all act (management companies, HOA, malls etc ). They just do not want to get involved.
