No. Both parties agree that it was the other driver's fault. She was even given a citation by police.

Some of my colleagues were sating that you don't get a fair price. Again, all this is new to me and I am learning as I go along. I was not invested in any particular option because I did not understand/know much.

It looks like I may have made a wrong choice

Some states are no fault and others aren't.


In Michigan you have to get your insurance involved no matter what, their a no fault state.

Where as in Illinois you can just deal with the person that hit you insurance company.


It varies from state to state.

You can negotiate the amount, but you’ll have to do some due diligence and be ready to hit them with facts.

If you’re ok with having a big repair, close to matching paint, and depreciated value then keep it. If you want a fresh start, go for the total loss and negotiate a settlement that you’re happy with.

You pay deductible only if it's your fault

I had similar situation, someone rear ended me luckily it was my pickup, my insurance was dealing with that, it was not my fault and I didn't have to pay deductible

This happened to me and my wife. I t-boned a Ford raptor and damage was minimal (hood, bumper, headlight) but all the air bags went off. They totalled the car with only 6000 miles on it. I really didn't want to drive a car that was fixed after a major accident. My insurance totalled it but his insurance didn't want to total it. It was other drivers fault so geico took it to arbitration and totalled it out

I think if you want your own insurance to go after other parties, you have to pay for deductible and then once they figured out I got it back 3 weeks later

That's exactly what they told me but because it was 100% his fault from the beginning they didn't take deductible

In most cases you pay the deductible regardless; then, after your insurance successfully subrogates the other/at fault party, you get your deductible back. Obviously, some ins.co may be nicer than the others.

While totaling the car at other party's expense is the best outcome, getting the fair value out of them is still a potential battle for OP.

And if you end up keeping this x5, make sure your claim for diminished value. When you go trade in or sell your x5, an accident on record will lower its value.
