Regardless of waiver usually these companies have some sort of insurance and if this guys owns his own car would have coverage.

Imagine the guy drives a late model Camry. His insurer factors in replacement and/or repair costs of that Camry when calculating his collision premium. Then he totals an M6 that's worth 7x what he's insured for... how does that work?

The Dealer plate covers incidents along with Dealership liability insurance. The individual is not on the hook for anything unless they were DUI/DWI. This is the reason most Dealerships do not allow prospect test driving alone because their insurance will not cover if employee is not on the test drive.

I am not sure of the details and I am certain the coverage varies by region however here in most cases the Dealership's insurance covers the entire incident if the driver was at fault despite taking a copy of the driver's insurance card. It is the main reason why insurance for auto industry is so high around here. Insurance company will fight hard to prove the other party was at fault (if possible) or that the Driver's insurance should cover but if not they will cover. If the the commercial insurance does not cover the entire claim (repair, injury etc.) the secondary insurance will/should pick up the difference.

Why did the driver thought about going nuts in this test drive car? Surely he didn't know how to harness all that power. I wonder if the CA asked him to punch it and it back fired?

if that waiver holds up then i would assume so. (my comments were regarding a standard test drive where a prospect would drive a vehicle with the intention of buying it.) it appears BMW got more publicity than they anticipated with this little test drive event at CES.

The owners of any vehicle, dealers included, are responsible and their insurance is considered primary coverage. When you hand your keys to anyone, they are driving on your insurance.
