I recommend from experience that you go dark for a few days. Do nothing. The longer they hold it -you've reached that point- from here on the more they are on the hook. Nearly all lemon laws have a 30 day (cumulative) clause.

Separately, I believe when you code some lock features (don't know if you have), you may remove the safety feature that requires the hatch button to remain pressed for 2 seconds before it opens up. And, with one touch, it can open.

So - got the car back, after 3 (!) weeks. They ended up replacing the tail gate switch (the door panel one), and say they can't replicate it anymore. If it's gone, it's gone - I don't care. Got a nice present to go with it. Beyond furious (that would be my wife taking the picture).

Who at BMW should I be contacting to get a month's worth of lease refunded? The SA I'm working with says it's going to take him a few days to contact the regional BMW rep, and I'm not particularly confident in his incentive to do so.

To get my lease payment check I called bmw of NA. They were able to work with the dealership. The dealership mailed the check to me for my full monthly lease payment. I just told bmw of NA, "I understand there are problems that need to be resolved and I'm not upset, I just don't think I should have to pay for a car that I can't drive." Then not long after the check arrived.

So... this is back. Walked out of the office on Wednesday (downtown Chicago), my car is parked on the street with its trunk wide open. Thankfully nothing stolen.

Drove to lunch, park, shut the door, trunk pops open. Close it again, start walking away, it pops open. Had to ask the hostess of the lunch place to keep an eye on it. Went back to service today.

I'm gonna start talking to them about a buyback. This is the start of week 4 in the shop for this issue. Ludicrous.

It's actually easier than you state. I've done it twice. When it happened I looked at my pocket and clearly saw why it happened and the object that pushed the button. Now I'm more careful and it hasn't happened again. BMW should have recessed the trunk button.

Lemon laws are very different depending on state. You may have to give them proper notice that you are pursuing lemon law before the clock and/or number of attempts to fix starts.

In most cases, once they've had the car for over 30 days, or three times for the same defect, you have to initiate the lemon law which gives them ONE last chance to repair the defect.

Yes, it's buy back time.

BMW knows that the cost to get you out if your car to keep you happy and loyal is totally worth it.

Even though it's not a sophisticated engine problem, BMW will cooperate.

In fact, since you're not dealing with a sophisticated issue (at least on the outside) it really comes down to numbers.

Even if they fix it, the next time you have any kind of problem with anything, you're going to go ape shit.

BMW understands this.

I would start by letting them know you want out. Then, be reasonable, no threats.

Just drive the loaner and don't even ask about the status of your repair.

Once you get past 30 days, it's game over. By your not complaining, inquiring, or even checking on the status, you will be giving the dealer enough rope to hang themselves.

So, sit tight. Plant the seed by telling them you want out. And, then play the game.

Sooner or later BMW will make you the offer.

Good luck. Please keep us posted. Although, if they do buy it back, you will sign a contract that says you can't tell us.

I bought the key cover and haven't had an issue since with the rear door opening. Are you sure its not the key?

I agree that it is easy to accidentally pop the trunk open. What I did to work around this issue was to face the button side of the fob against my thigh so that I don't accidentally press the button. yeah, I was very mindful of the key when it happened 3 times in a row.

thanks. i'm hoping to keep this civil. between me and my family, this is our 10th bmw, and I'm happy to stay with the brand, just not this car.
