Class Action - Comfort Access Locking
Received a letter today and thought I'd share this with you all even though I don't own a E70...
This is addressed to those that: Ever owned or leased a October 1st, 2006 through June 30th 2013 (production date) X5 E70 with optional Comfort Access System. Case - Myers v. BMW of North America You may be entitled to benefits under this proposed class action settlement. Attached are some items of the letter that I received... you can also call 877-310-3707 or visit www.ComfortAccessSettlement.com The Interesting thing is...that I had this problem on my F15 as well... wonder if I'll get one of these again... for my current vehicle... Did anybody else have this issue on theirs? Gladly I was able to unlock it with my phone when it happened... |

This is one of the reasons I despise the class action system is somehow my contact info gets leaked and next thing you know, I get a fresh set of spam and junk mail.
That said I've never had this happen to my E70 or the F15... I also don't leave my keys in the car to make it easier for a thief to drive away.

I spoke with one of the Attorney’s (via E-mail) because I had read that the suit also included 2015 X5’s. He sent clarification in form of the actual filing that limits the suit to those who purchased or leased “X-5 vehicles, with a production date from October of 2006 through June of 2013.”

Just got one too for my old e70 which I no longer have, never had a problem, never took the fob out of my pocket, ever see that movie idiocracy?

I actually had these issues in my 2014, comfort access unlocking in the middle of the road. Dealer replaced quite a bit of stuff ($2k worth) when I complained and it went away, this explains why.

i blame this on user error. i suspect ppl who have this problem open the door by grabbing the door handle with the thumb extended in the horizontal position, parallel to the door handle, brushing against the lock section when opening the door. i always pull on the door handle with my thumb wrapped under the handle.

No I can guarantee you some of this happened from some sort of phone interference. My SA confirmed this. A lot of 2014 models and iPhone 7 models had issues. I moved from a 2013 750 with CA to 2014 and it was very evident. After hardware swap not one issue since.

if you read the details there's a line in it where the lawyers get like $900K in fees, the primary litigant gets a whopping $5K finders fee and probably the $200 pop a lock fee. Ah to be a lawyer.
