F15 X5 Tailgate Issues HELP!

Hey, so I own a 2014 X5 35D, and the tailgate is not working at all, this issue started at the same time I started seeing a warning messege on my dash, says Boot lid not closed, I've tried slamming it, using WD-40 on all the mechanical parts visible but nothing seems to work, I've been opening and closing it manually since then, any idea where the issue might be with the boot or bottom tailgate, I'm guessing that's why the tailgate doesn't want to open or close automatically while the bottom half appear to be "open".
