Based on Alan's comments, I believe it is the other way around; he intended to park in the spot nearest to the camera, and spilled over into the clown-car parking spot. Thanks for the updated pics E92M77.
What they re-iterate is that the space taken by the red 3-series is not a legal spot because there is no horizontal stripe. If it backed up three more feet, would you claim that car was double parked front-to-back? Furthermore, your first pic shows exactly why he parked over into the non-spot... look at the silver Bimmer. It's on/over the line.

if you look at the picture with the back of the red 3 series, it doesn't look like a legal spot to me because there's no parking line. The aerial view however seems like it is a parking spot. there seems to be something wrong with that cement curb/ divider. It's there in the aerial view but not there in the rear view picture of the 3 series. can't tell who's right and who's wrong from those pictures lol

From the aerial view it looks mostly like a parking spot to me, but maybe it wasn't as obvious at street level? Definitely a strange parking lot though. Given the lot wasn't empty I wouldn't have risked it! I know many people that would screw with a vehicle parked like that and felt good doing it, especially a new BMW.

Wow still going on with this huh....
Pics proves my argument. It's a weird spot and the lines reflect it. I'm sorry I don't have a helicopter to verify if the lines looks like a spot or not before parking there. When I pulled up to the spot on street level I didn't see there was a horizontal line there like all of the other spots so to me its not a spot. Looking at the arial view is the red car suppose to park all the way forward or next to me? Frankly I don't give a shit if the OP isn't happy with my parking. I came back to my car dingless after having some good pho and left heading back to NY with the rest of my family without incident. Live with it OP. If you caught me straddling two spots in a sea of identical parking spots at the mall or target etc... I would man up and admit it. This is not it so i stand by my post.
