Egr bypass question

I have a VW TDi, I removed its EGR, then I cut the plunger and blocked off the exhaust intake.
Basically my ECU sees the EGR working just fine, even though my intake does not suck in exhaust.It does not throw a code or check engine light.

Can I do that with my 2014 X5 35D? Will it throw a code/check engine light?
