I went in service for a failed steering motor when then my sa brought to my attention that my rear seats could be replaced as he labeled them as "defective" considering I had only 35k miles at the time. It was nothing too crazy like yours just a few wrinkles and minor cracking. I guess it depends on the relationship with your sa and how far they want to go for you. Keep pushing your sa as that is unacceptable for a car with just 40k miles or try another dealer as this seemed to have worked for others here.
