EGR Cooling issue

I recently brought my X5 35D to the dealer in Miami because I have an EGR issue.
My EGR system, per dealer is under warranty, however they refused to replace my EGR cooler.
They came up with an astronomical $4000 quote to update the car's software, per Dealer, it hasn't been updated since 2016, plus price for tires etc. (All I wanted was my EGR cooler to be replaced under warranty, nothing else)
I have this code:

I now want to remove the EGR cooler and EGR but I cant afford tunning. Will my car go in a limp mode if I remove the EGR and the cooler?

Did you do the recall?
https://f15.bimmerpost.com/forums/sh....php?t=1891695
I think no matter what you are covered, if recall work is not done yet-do it, they will have to replace EGR cooler if needed. If it was done-it is covered by 2 year warranty so once again if its a problem, they will have to replace it. Do you need to do a smog check in your state, why do you want to remove EGR cooler? No way any BMW dealer will charge $4000 for iStep update,do you have official quote for that?

Yes, I did the recall, you are picking up pieces only. The $4000 was for tires, EGR, Updating the system plus SRC mettering valve.
No smog or emissions testing in my state.
We usually remove EGR to keep intakes from building up carbon.
But if I do that, I dont want to get a constant CEL on.

That's what you wrote, $4000 for update plus price for other items. So if you did the recall and got check engine light dealer should fix it, these items are related to recall work. You can get tires from tire rack or elsewhere. And why do you need new SRC metering valve? This is not the only error you have? If you don't have emissions testing you can get the delete. thread with all the information you need is here:
https://f15.bimmerpost.com/forums/sh....php?t=1525210
But if the main question of this thread is "Will I get CEL if I just remove EGR" the answer is yes, if you proceed with delete you need hardware and software delete, otherwise your car will see missing components and report problems.
