Did your shop try to clean it in situ or remove it and clean it? I can't believe in situ would be as effective.
There is a DPF counter in the DDE that "expires" the DPF. It can be reset after a cleaning.
I'm surprised the DPF itself is not covered under one of the 120,000 mile emissions warranties.

Definitely file a case with NHTSA regarding it. Enough cases and BMW will be forced to extend the warranty on them or issue a recall. You will be entitled to a refund of this repair should either of those 2 things occur.
