X5 40e: Qualify for US tax credits?

An email to FuelEconomy.gov got a quick reply that the government has not yet decided if the X5 40e will qualify for a tax credit.

By the IRS formula, it's 9kwh battery would appear to meet criteria for about a $3,500 credit.
