All F15 X5s I've seen are like this. I thought mine was messed up too when I first got it, but either this was an intentional design choice by BMW or it was just messed up and they left it that way throughout the entire run.
I will say that the left fender is more pronounced than the right on my car. |

If you open the door and look at the top rear of the fender you will see a TX30 bolt head that hold the plastic fender. It goes through a black washer/retainer. Loosen the TX30 and then push inward on the top rear fender and tighten again. That adjusted my gaps to a level my OCD doesn't flair up every time I get in the car. I do think it is the plastic fender shrinking a bit ad shifting the fit in that area.
