Highly unlikely to pass emission tests in California. But if anyone is bold, the price of the engine is actually quit cheap -as if two sets of ultra high-end wheels and tires. Heck, some ecu tunes can be about half the price. Also, you'd kiss the warranty goodbye, and eventually end up a mater coder.

Not sure if our US spec transmissions can handle the additional torque though ?
Plus probably need to upgrade the cooler also? Oh well, one can dream.

I wonder what the cost analysis would be for the following two situations:

Buying a US Spec X5 and paying for the parts, labor, and other associated costs of swapping an M50d engine and/or transmission
Trying to find a way to import an M50d to the US, and paying for the associated import costs and other fees
